Wreck may spark lawsuit

MOULTRIE — Another $1 million lawsuit could be coming the county’s way.

This most recent claim is unrelated to the hefty stack of multi-million dollar suits over the former drug task force.

The daughter of a Moultrie woman who died as a result of injuries sustained in a car accident July 29, 2001, may sue Colquitt County for negligence and wrongful death.

Dena Faye Barrett, the daughter of accident victim Alice Faye Wright, 54, formerly of Sardis Church Road, claims a large utility pole within the right-of-way of the northeast corner of the intersection of Woodmen Road and Sylvester Drive obstructed her mother’s view. Wright entered the intersection and was hit by an oncoming vehicle.

Barrett is seeking compensation for medical expenses, pain and suffering and funeral expenses, according to an ante litem notice to county commissioners dated July 15, 2002.

Wright died Sept. 12, 2001, at Shands Hospital in Jacksonville while being treated for injuries sustained during the two-car collision.

Wright’s vehicle, traveling west on Woodmen Road, was struck by another car traveling south on Sylvester Drive at around 8:12 p.m. in clear, dry conditions, according to a Georgia State Patrol report.

The drivers of both vehicles involved in the accident were traveling alone, the report said. Both had only complaints of injury at the time troopers compiled the report, GSP officers said.

Wright was transported to Colquitt Regional Medical Center and later transferred to Shands where she lay in hospital for about two months until her death, according to information from both the GSP report and the notice.

Troopers charged Wright with failure to yield, and no other contributing factors were listed on the report that would have caused the accident, they said.

Barrett claims the GSP is inaccurate, saying her mother stopped at the intersection, the notice said.

County Attorney Bill McCalley said the notice was forwarded to the county’s insurance agency.

The Observer was unable to locate Barrett for comment. Her attorney, Thomas Kirbo did not return telephone calls regarding the claims Friday.
