Accused murderess waives right to jury trial as plea deal sought

DALTON, Ga. — A plea deal is being sought for a woman charged with murder who admitted to shooting her father in the head in a call to Whitfield 911 in October of last year.
Hannah Celese Henderson, who was indicted for two counts of murder, aggravated assault (family violence), possession of a firearm during the commission of a crime and possession of meth, appeared Tuesday morning before Superior Court Judge Cindy Morris. Henderson waived her right to a jury trial, and District Attorney Bert Poston said in court he and Public Defender Natalie Glaser are finalizing the details of a plea agreement.
“Miss Henderson has executed a written waiver to the right to a jury trial, which is in the file on the bench,” Poston said, standing with Glaser at the lectern with Henderson between them. “We wanted the court to go over that with her on the record and get her to acknowledge that on the record and make sure that she understands that should some things we are working on fall through or she change her mind, that she cannot undo this.”
Morris read Henderson her rights should she seek a jury trial and the 26-year-old said she understood what the waiver means.
“Are you giving up all those rights this morning and waiving your right to a jury trial?” Morris asked.
“Yes, ma’am,” Henderson said.
Henderson was indicted in November for the Oct. 13 shooting death of 50-year-old George Samuel Henderson. She claimed in the 911 call she shot her father “because he was molesting my son. I walked in and saw him.” Whitfield County Sheriff Scott Chitwood said in a press release at the time that the “evidence collected at the scene did not support” her version of what happened at 4045 S. Dixie Highway.
The press release said George Henderson died from “multiple gunshot wounds,” and the sheriff’s office said he was shot twice in the head.
In the 911 call, Hannah Henderson said she shot her father in the head. She said the gun was “a .38, I think.” In the indictments, the weapon is identified as a Ruger LCP .380 caliber, and one indictment accused Hannah Henderson of shooting her father “with malice aforethought,” meaning the district attorney’s office contends the killing was premeditated.
George Henderson’s sister, Frankie Shipman, said shortly after his death that her brother would never have hurt his grandchild.
“The allegations that she is accusing him of are very untrue,” Shipman said. “My brother … that child was his entire world. I know his name has been smeared by her, and I can bring over 100 people who could testify to how much his grandbaby meant to him. I just want the public to know that those allegations are completely false. He would never hurt his grandbaby.”
Members of the family, who sat in two rows of the courtroom reserved for them, declined to comment after Tuesday’s hearing, saying they will speak once the case is concluded. Both Poston and Glaser declined to comment.
The case was set on Judge Jim Wilbanks’ plea calendar for May 14.
