Five charged for roles in alleged rape

DALTON, Ga. — Three men and two women face felony charges in connection with an alleged rape in Whitfield County on Sunday.

According to a Whitfield County Sheriff’s Office incident report, a deputy was sent to Downing Street just east of Dalton at around 2:50 p.m. on Sunday following a report of a woman being sexually assaulted. When the deputy arrived, he was “flagged down” by the caller.

The woman said she’d been visiting the Dalton area and was “spending time” with Amy Louise Marie Jones, known to her as Amy Walden, on Sunday at approximately midnight when Jones took her to a trailer on Richardson Drive where two men raped her. She told the deputy that meth “was involved.”

According to the incident report, the woman said there were five people present besides herself: Jones, Marlon Bradford Burk (known to her as Marty Burk), “a female potentially named Lindsey …” and two unidentified men. She said the two unidentified men raped her, and Burk and Jones “instructed them to do so.” She said “the individuals claimed to had association with the Mexican mob” and that she “had a hit on her for being an informant for the federal government.”

The report said the deputy asked dispatch to call the on-duty detective. The detective arrived and interviewed the woman, then the deputy took her to Hamilton Medical Center. The woman said her phone and the keys to her vehicle had been taken while she was in the trailer.

The deputy ran her name and found the tag number for her vehicle. He found she had an active misdemeanor bench warrant, according to the report.

Burk, 34, of 299 Old CCC Camp Road-C, Chatsworth, was charged Wednesday by the Whitfield County Sheriff’s Office with terroristic threats and acts, felony theft by taking/larceny/theft of an automobile, parole violation and false imprisonment.

Richard Lawrence Forrest, 33, of 247 Burns Kendrick Road, Dalton, was charged Wednesday by the Whitfield County Sheriff’s Office with rape (strongarm), terroristic threats and acts, aggravated sodomy and false imprisonment.

Jones, 39, of 3962 Miller Drive, Dalton, was charged Wednesday by the Whitfield County Sheriff’s Office with terroristic threats and acts, felony theft by taking/larceny/theft of an automobile and false imprisonment.

Lindsey Lowe, 33, of 1934 Collins Road S.E.-A, Dalton, was charged Wednesday by the Whitfield County Sheriff’s Office with false imprisonment.

Richard Marvin Smith, 51, of 172 Shirley Way, Dalton, was charged Wednesday by the Whitfield County Sheriff’s Office with rape (strongarm), aggravated sexual battery and false imprisonment.

All five were being held in the Whitfield County jail on Thursday afternoon. Burk, Forrest, Jones and Smith were being held without bond. Lowe had a property bond of $3,000.
