DALTON, Ga. — A Dalton man whose daughter said he broke into an attic in violation of a protection order had further charges tacked on by police when he bit an officer on the leg and told another he was going to kill him, according to a Dalton Police Department incident report.
Jesus Beltran-Triana, 47, of 1009 Foster St., was charged Saturday night with aggravated stalking, terroristic threats and acts, simple battery against a law officer, burglary in the first degree and willful obstruction of law officers.
Dalton Police had been called to a residence of Beltran-Triana’s ex-wife, who had a restraining order from the divorce which was finalized in August, according to the report. The ex-wife and her daughter had arrived at home to find Beltran-Triana in the home. The daughter said she was able to get Beltran-Triana into a room by himself so her mother could hide. She later was able to leave the house and hide at a neighbor’s home.
The daughter showed police where she believed Beltran-Triana entered the home, climbed a ladder and remove ad vent panel from the attic. The daughter also said Beltran-Triana had fallen from the ceiling and hit the floor.
The report noted that Beltran-Triana was “extremely intoxicated, “slurring his speech and “could barely maintain his balance.” Officers had Beltran-Triana handcuffed and sitting at a table while they spoke with those at the scene, and he told one officer he was going to kill him. He also became uncooperative as officers tried to search him and walk him outside to the patrol car.
Officers found “several” bullets, according to the report, but no gun was found, and the daughter told police Beltran-Triana had cut his wrist with a pocket knife, but no knife was listed in the report.
While officers were trying to search him and walk him out, he struggled, pulled away, let his body go limp and dragged his feet. Once he was put in the back seat by officers, the report said he hit his head repeatedly on the plexiglass on the back window. The officer wrote when he opened the door to check on him, Beltran-Triana threw himself out of the car, falling to the ground.
While officers were trying to get him back in the car, he bit Officer Evan Lynn Driskell on the leg and kicked Officer Steven Tyler McBrayer in the leg. After officers got him back into the car and had EMS check to make sure he wasn’t injured, he was driven to the jail and was banging his head on the cage in the car. The reports said he also continued to beat on doors and was taken to a padded cell at the Whitfield County jail.
Beltran-Triana remained in custody at the Whitfield County jail Monday awaiting a bond hearing.
