Freckles hearing delayed; work begins on project

MOULTRIE — Road construction is under way near Freckles Skating Center on Quitman Highway but that work stops at the Freckles property line.

A hearing had been scheduled for Tuesday in Superiior Court to determine whether the state Department of Transportation could secure an easement for road construction affecting the Freckles property but that hearing has been postponed for now.

Freckles owner Larry Richardson said the hearing was postponed because his attorney had a scheduling conflict. No new date has been set for the hearing.

The roadwork is part of an effort to reroute Old Adel Road to intersect Industrial Drive and to reroute Fifth Avenue Southeast to meet Industrial Drive at Quitman Highway.

Richardson contends that the work would mean an inconvenience for Freckles customers and a loss of business. The DOT has offered him $10,996 to secure the easement but Richardson rejected that offer as well as an earlier offer of $5,000. He claims that to comply with the DOT’s plan would cost him more than $50,000.

Judge James G. Tunison Jr. in January, after an initial Superior Court hearing, ruled that the roadway changes would create a safety hazard for motorists and that the money offer was inadequate.

Richardson has said he would comply with the DOT plan if the state would cover the costs of compliance. The work he would assume includes the cost of asphalt to connect a driiveway to the  road’s right of way, to replace parking spaces in front of Freckles and to erect traffic signs and put up a fence.

The DOT has begun work on the road but that work stops at the Freckles property liine.

“I can’t stop them from doing work down the street,” Richarson said.

That work is part of a $2.5 million federally funded project to be completed in November 2013.
